1. Seller and contact details
This store is operated by MERRICRATE, obrt za trgovinu, vl. Leon Krišto, trading as Merricrate ("Merricrate", "we", "us" or "our").
Podbrežje VI. 23A, 10020 Zagreb, CroatiaCustomer service: support@merricrate.com
Business telephone: +385 99 203 9928
Email is our preferred channel for order assistance and written complaints. Telephone calls are subject to your provider's ordinary call charges; we impose no additional customer-service call fee. Return-parcel addresses and handling instructions appear in our Returns & Refunds Policy.
2. Scope and consumer rights
These terms govern use of merricrate.com and consumer purchases accepted through our checkout. They should be read with the product information, order details and Returns & Refunds Policy provided before purchase. The Privacy Policy explains personal-information processing; acceptance of these terms is not consent to optional marketing or non-essential cookies.
Nothing in these terms excludes or restricts mandatory consumer protections. If a provision conflicts with a mandatory right, that right prevails. Our policies describe purchases for EU and USA destinations where ordering is available; they do not mean every product or destination is currently enabled.
3. Orders and contract formation
You must have legal capacity to enter a purchase contract. Provide accurate contact, billing and delivery information and ensure that you are authorised to use the selected payment method. When sending a gift, provide accurate recipient details and check any personalisation or gift message before ordering.
Choose the goods, review your cart, enter the required checkout details, select an available payment method and review the total before placing an order. You can correct information before submitting it. Submitting the final checkout order creates an obligation to pay the displayed total. A sale contract is formed when our automated Shopify order-confirmation email is sent to you after you place your order. This confirmation accepts the order; it does not mean the goods have been dispatched or that a pending payment has completed. Any outstanding payment remains due under the payment method and terms shown at checkout. A payment authorisation without an order confirmation does not by itself form a sale contract.
We may decline an order before acceptance for a legitimate reason, such as unavailable stock, an unsupported destination, failed payment or a substantiated fraud concern. We will inform you and refund any payment collected for an unaccepted order. After acceptance, we will not change the agreed price or substitute goods without your agreement. An error does not give us an unrestricted right to cancel a binding contract; applicable law governs any correction or cancellation.
Save your confirmation and the terms supplied for your purchase. Contact us if you need a copy or notice an error after ordering. We will provide the contract confirmation and legally required information on a durable medium, such as email, within the legally required time. These are the English-language terms; mandatory local-language information requirements remain applicable.
4. Products, prices and payment
The product description and selected options identify what you are buying. Images illustrate the goods; differences in screen display do not override the product description or excuse material discrepancies. Applicable product warnings, limitations and personalisation details form part of the information you should review before purchase.
Standard outbound shipping is included in product prices. The applicable currency and total payable are shown before you submit your order. Prices displayed to EU consumers are final consumer prices, including any VAT that we are legally required to charge. The tax amount, where applicable, is identified in the order details; we do not represent that VAT is charged on every sale. Any separately selected premium service and any USA sales tax that applies are shown before payment. We do not add undisclosed charges after purchase. Accepted payment methods are those actually offered at checkout; displaying these terms does not promise that a particular payment provider is available.
Payments are processed through the payment services used at Shopify checkout. Merricrate does not directly store your full payment-card number or card security code.
5. Delivery and approved fulfillment routes
For EU orders, we use verified stock located in the EU and already in free circulation. We do not use non-EU-to-EU fulfillment routes for launch orders.
For USA orders, we use approved delivered-duty-paid (DDP) routes. For an order accepted on such a route, applicable import duties and import-clearance charges are handled through that route rather than collected from you on delivery. This does not remove any sales tax shown at checkout. We do not promise customs treatment for unsupported destinations or routes. Contact us if a carrier requests an unexpected import charge.
Product- and destination-specific dispatch and delivery information will be provided before purchase. Standard shipping being included does not mean delivery is instantaneous or that every order has the same delivery time. If an order is split into parcels, this does not create extra standard shipping charges.
For EU consumers, unless we agree otherwise, goods must be delivered without undue delay and within 30 days after the contract is concluded. If delivery is late, you may give us an appropriate additional period to deliver and terminate if we still fail. You need not give an additional period where the law permits immediate termination, including where we refuse delivery or timely delivery was essential in the relevant circumstances. Refund and other mandatory remedies remain available.
For USA orders, we must have a reasonable basis to ship within the promised time, or within 30 days if no shipment time is stated. If we cannot, we will provide the legally required delay notice and choice to consent to delay or cancel for a prompt refund, and cancel and refund where required if consent is not obtained.
We remain responsible for our obligations as seller when a supplier or carrier performs fulfillment. For EU consumers, transit risk normally passes when you or your nominated recipient, other than the carrier, take physical possession. The statutory exception for a carrier independently commissioned by you and not offered by us remains applicable. Please report missing or damaged deliveries to us; a carrier's delivery scan does not by itself settle a disputed delivery.
6. Cancellation, returns and guarantees
Contact us promptly if you wish to cancel. Our customer accounts offer cancellation requests before fulfillment and return requests for eligible delivered items. A fulfillment status or unavailable online option does not remove statutory withdrawal or other legal rights. If a parcel has already shipped, we may be unable to stop it, but will explain the applicable return procedure.
EU consumers have the statutory 14-day withdrawal right and its legally required return and reimbursement deadlines, subject to lawful exceptions. For USA deliveries, our voluntary policy allows return requests within 30 days after the last item in the order is delivered. Details, return addresses, the optional EU withdrawal form and refund arrangements are in the Returns & Refunds Policy, which forms part of these terms.
Ordinary change-of-mind return postage is customer-paid where legally permitted and properly disclosed. There is no standard restocking fee or direct change-of-mind exchange. Necessary costs of remedies for faulty, damaged, incorrect or non-conforming goods are borne by us where required by law.
EU consumers have a legal guarantee of conformity of at least two years from delivery, with longer national protection and all other mandatory rights preserved. Depending on the circumstances, remedies include free repair or replacement, price reduction or termination and refund. Any commercial warranty is additional. USA statutory and binding warranty rights are also preserved. Ordinary return windows and product-specific withdrawal exceptions do not extinguish these rights.
7. Written complaints and dispute resolution
You may submit a written complaint by email to support@merricrate.com, by post to our Zagreb address, or at our business premises. We acknowledge receipt without undue delay and give a written response within 15 days of receipt, stating whether we accept the complaint as justified. This is a response deadline, not a promise that every matter will be fully resolved within that time.
If a complaint remains unresolved, a relevant Croatian consumer dispute-resolution body for disputes with crafts businesses is the Court of Honour of the Croatian Chamber of Trades and Crafts (Sud časti Hrvatske obrtničke komore), Ilica 49/II, 10000 Zagreb, Croatia. Contact: sud-casti@hok.hr; procedure and eligibility information. We will comply with applicable participation obligations and provide the required information about dispute resolution in our response to an unresolved complaint. This does not create a mandatory private arbitration agreement or remove access to competent courts or public enforcement authorities.
8. Website use and intellectual property
Use the website lawfully. Do not interfere with its security, submit fraudulent orders or upload unlawful or infringing material. Only provide gift messages or other content you have the right to use. You retain ownership of your content and permit its use only as needed to provide the requested service and handle the order.
Website text, branding and other protected content belong to their respective rights holders. You may browse the store and retain copies needed for your personal purchase and legal records. Other use requires permission where intellectual-property law requires it.
Shopify supplies the commerce platform. Your goods purchase is with Merricrate. Third-party websites or services may have their own terms, but using them does not reduce our responsibilities to you under your purchase contract.
9. Responsibility and applicable law
We are responsible for our obligations under the contract and applicable law. We do not exclude liability for fraud, wilful misconduct, gross negligence, death or personal injury where liability cannot lawfully be excluded, product liability, or mandatory consumer remedies. No general website disclaimer overrides an accepted order, product description or legal guarantee.
Croatian law governs these terms, but if you are a consumer this choice does not deprive you of mandatory protections under the law that would otherwise apply, including the law of your habitual residence where applicable. Mandatory rules on jurisdiction remain unaffected. These terms do not require you to bring a claim exclusively in Croatia or waive rights to collective or other proceedings available under applicable law.
10. Changes and contact
We may update these terms for future transactions by publishing a revised version. The version applicable when your contract was formed continues to govern that purchase unless a lawful change is expressly agreed. If a provision is unenforceable, the remainder applies only to the extent permitted by law, without reducing mandatory consumer protections.
For questions about these terms or an order, contact support@merricrate.com.
